Lawyers employed by legal services are subject to the Labor Standards Law since April 1, 2014. Legal service institutions shall declare and pay labor pension for their employed lawyers in accordance with the Law to safeguard workers' rights.

Council of Labor Affairs, Executive Yuan had announced the Bulletin No. 1020132124 in Labor Law 1st on October14, 2013 that lawyers employed by legal services are subject to the Labor Standards Law with effect from April 1, 2014. In accordance with Article 6,7and 14 of Labor Pension Act as well as Article 8 of Enforcement Rules of the Labor Pension Act, the applicable targets of this Act are workers who are applicable for Labor Standards Act (including Taiwan nationality, foreign spouses, spouses from the mainland, Hong Kong and Macao). Lawyers employed by legal services are subject to the Labor Standards Law since April 1, 2014. The employer shall make pension contributions for lawyers hired since the date of employment. The application way is to fill in "Labor Pension Contribution Application Form" by the rule of ” workers applicable for Labor Standards Act with their contribution status ( 1 ) " to report contributions for labor pension since April 1, 2014 . If the applicants for contributions (including employer or individual voluntary contributor ) who are “inapplicable for Labor Standards Act with their contribution status ( 2 ) " before April 1, 2014 also report their contributions for labor pension with reference to the said “applicable for Labor Standards Act with their contribution status ( 1 ) " . When lawyers newly taking office since April 1, 2014 apply for labor insurance and labor pension contribution, they shall fill in declaration form of labor, health insurance, labor pension plus extra insurance (3 in 1) to complete labor, health insurance and labor pension contribution simultaneously.

If Legal Service Institutions haven’t yet joined labor pension contribution, please fill in "Application for Labor Pension Contribution Unit" and "Labor Pension Contribution Reporting Form" and submit BLI the filing or registration documents and photocopy of ID card of the person in charge to open an account for these institutions, and report the pension contributions for their attorneys. As these institutions are compulsory to insure employment insurance, if persons listed in contribution declaration form are eligible to employment insurance rules for participation after audit, BLI would allow them to insure employment insurances to maintain workers’ rights.
