Relax the Accreditation Requirements for Qualification of Labor Insurance Disability Benefits as of Aug.13, 2013

The insured person on labor insurance requesting for disability pension must comply with those disability statuses of being “incapable of work for the rest of their lives” listed in the attached table of Standards of Labor Insurance Disability Benefits; however, the accreditation requirement for qualification of labor insurance disability benefits will be relaxed as of Aug.13, 2013 to maintain the insured person’s rights in applying for payment.

From Aug. 13, 2013, the insured person applying for disability pension also conforms to the qualification of applying for disability pension if the insured person not only meets disability status of the preceding “incapable of work for the rest of their lives” but is also reviewed by the Bureau of Labor Insurance to meet overall disability degree Level 1 to 6, or evaluated not to return to workplace with more than 70% lost work capability after an “individual professional evaluation”.

The Bureau of Labor Insurance takes an instance that an insured person aged 44 engaging in the manufacturing business is diagnosed with a permanent disability and is not able to return to the workplace due to the above knee-joint amputations of both lower extremities applies for the payment of labor disability pension, and overall disability degree meets Level 2 reviewed by the Bureau of Labor Insurance; however, his disability status is not attributable to being “incapable for work for the rest of their lives” as listed in the attached table of Standards of Labor Insurance Disability Benefits. As a result, the insured person does not meet the qualification necessary to apply for a disability pension and the Bureau of Labor Insurance shall pay once only.

Nevertheless, the same case subject to individual professional evaluation will be firstly calculated according to the degree of body injury of the insured person and injury percentage for the whole person before considering future work capacity, occupation and age in order to comprehensively evaluate the insured person’s work capacity. Those who cannot return to the workplace with more than 70% lost of work capability will qualify to apply for a disability pension of labor insurance.

The Bureau of Labor Insurance reminds us that the insured person applying for disability pension conforms to the disability status of being “incapable of work for the rest of their lives” as listed in the attached table of Standards of Labor Insurance Disability Benefits reviewed by the Bureau of Labor Insurance, or those applying for disability pension shall withdraw insurance from the date of the permanent disability diagnosis.
