For those insured through occupational unions or fishermen's associations, the insured unit should immediately withdraw the enrollment if the insured person is no longer physically engaged in the business in the country
Labor insurance is offered to the individuals who are holding jobs in specific geographic areas. An individual will only be allowed to participate in the program through the occupational unions of the industry he/she works for or through fishermen's associations only if he/she is physically engaged in the business in Taiwan, Penghu, Kinmen or Matsu areas, and is not affiliated with a fixed employer, or is a self-employed operator.
The Bureau of Labor Insurance (BLI) reminds the public that, if a person has been working overseas or in China on a long-term basis, he/she is not entitled to enroll through an occupational union or a fishermen's association, given the fact that his/her place of work does not fall within the applicable scope of the Labor Insurance Act. However, if the employee who is dispatched to work abroad is allowed to continue being enrolled through the original insured unit.
Furthermore, individuals who have been detained or suspended from work on account of a court case shall be allowed to continue being enrolled before the decision of the court is announced. The individual, however, is not allowed to remain being enrolled once he/she has been adjudicated guilty by a final judgment and is imprisoned.
The BLI emphasized that, if an insured person enrolled through the occupational union or fishermen's association is no longer physically engaged in the business in the country, he/she should inform the insured unit as soon as possible to withdraw the insurance, and should by no means continue with the enrollment purely for accumulating the labor insurance seniority. Such enrollment will be invalidated when discovered by the BLI in the future. The seniority with labor insurance will be negated and premium paid will not be returned. The BLI will recover the benefit payment already claimed, if any.
