2. How do I calculate the working seniority when I have participated in the employment insurance for 3 months after being hired again to a job?

According to the regulations prescribed in the Lao-Dong-Bao 1-Zi No. 1030140456 announced by the Ministry of Labor on January 15, 2015, working seniority is calculated according to the insurance coverage seniority starting from when the applicant completes one's first-time unemployment status examination and qualifies for unemployment benefits. However, the seniority for those who participated in employment insurance after being hired again to a job during the unemployment benefit period is excluded.

For example, if an applicant registers for seeking a job and applies for unemployment benefits on January 20, 2015, the public employment service institution approves of the applicant's unemployment status on February 3, 2015, the unemployment benefits is valid from February 3, 2015 to March 4, 2015, and the applicant participants in employment insurance on February 24, 2015 because of being hired to a job again, then the employment insurance coverage is calculated starting from March 5, 2015 and working until June 4, 2015, and the applicant can apply the early reemployment incentives only on June 5, 2015, three months and one day after March 5, 2015.
