Permanent Disability Allowances for the Diagnosis of Occupational Disease after Withdrawal from Insurance

Related regulations:

1. The average monthly insured salary shall be based on the average of the actual monthly insured salary during the 6 months before the month during which the insured person suffers the insured incident. If the period is less than 6 months, it shall be calculated based on the average monthly insured salary during the actual period of the insurance.
   If the average monthly insured salary calculated by the above method is lower than the amount of Level 1 of the insurance salary scale of the occupational accident insurance act at the time of diagnosis of permanent disability, it shall be calculated according to the amount of Level 1.
2. With respect to the permanent disability allowances for those who contracted occupational diseases after withdrawal from the insurance, the disability level and benefit standards are determined based on the disability level of different body parts, according to the disability items and levels specified in the attachments of the Labor Occupational Accident Insurance Disability Benefit Payment Standards(hereinafter referred to as Occupational Insurance Disability Standards ) and the Labor Insurance Disability Benefit Payment Standards(hereinafter referred to as Labor Insurance Disability Standards ).
3. According to the subparagraphs in Paragraph 2, Article 6 of the Labor Insurance Disability Benefit Payment Standards, if the disability in each part of the body meets 2 or more disability items, benefits shall be paid based on the highest disability rating or the highest rating plus 1 to 3 rating(s); or approved based on the total number of days for individual disability ratings.
