1. What are the eligibility, priority and payment standards for Survivor Benefit from labor occupational accident insurance?

Qualification:

  1. If the insured suffers occupational injury and death during the effective period of the insurance (or meets the provisions of Paragraph 2 of Article 27 of the Labor Occupational Accident Insurance and Protection Act, that is, the insured suffers an occupational injury or disease within one year after the termination of insurance coverage due to the same injury  or the disease caused by it), the person who pays the funeral expenses may apply for the funeral grant; the insured’s surviving dependent spouse, child(s), parent(s), grandparent(s) or grandchild(s) or sibling(s) who may apply for the survivor’ pension; if the insured applies for the insurance for the first time after January 1, 2009, upon the death of the insured and all of the surviving family members’ do not meet the requirements of the s survivor’ pension, they may apply for the lump-sum survivor benefits. If the insured has already been covered by the insurance before the implementation of the labor insurance pension on January 1, 2009, he/she may also choose to apply for survivor allowances.
  2. If the insured passes away during the period of receiving the complete or severe permanent disability pension, the survivors pension may be applied for.

Priority:

  1. Funeral grant:  The person who pays the funeral expenses.
  2. Survivors pension, Lump-sum survivor benefits and Survivor allowances: (1) Spouse and child(s), (2) Parents, (3) Grandparents, (4) Grandchild(s) supported by the insured, and (5) Sibling(s) supported by the insured.
※ The surviving family members’ (parent(s)) of the second priority may apply for the Survivors pension under statutory conditions. Please refer to Q&A 4.

Payment Standards:

  1. Funeral grant:According to the average monthly insured salary for the 6 months before the death of the insured, a 5-month funeral grant will be distributed, and if there are no surviving family members’, a 10-month funeral grant will be distributed to those who pay the funeral expenses.
  2. Survivor Pension
    • If the insured dies during the effective period of the insurance (or meets the provisions of Paragraph 2 of Article 27 of the Labor Occupational Accident Insurance and Protection Act): 50% of the average monthly insured salary for the 6 months before the month of the death of the insured will be distributed.
    • If the insured dies during the period of receiving the complete or severe permanent disability pension, half of the amount calculated on the basis of the permanent disability pension will be distributed.
    • Additional surviving family members’ benefits: When there are more than 2 surviving family members’ of the same priority, an additional 10% (up to a maximum of 20%) will be distributed for each additional member.
      (1)Lump-Sum survivor benefits:The lump-sum amount of 40 months of the average monthly insured salary of the first 6 months from the month of the death of the insured will be distributed.
      (2)Survivor allowances:The lump-sum amount of 40 months of the average monthly insured salary of the first 6 months from the month of the death of the insured will be distributed.

Requirements for claiming survivor pension:

  1. Spouse: Meeting one of the following requirements.
    • The spouse is aged 55 or more and the marriage has continued for one year or longer.
    • The spouse is aged 45 or more, the marriage has continued for one year or longer and the monthly work income does not exceed level 1 of the Insured Salary Category Chart.
    • No capacity to earn a living.
    • Support the child(s) mentioned in the following Paragraph 2.
  2. Child(s) (adopted children shall be adopted for more than 6 months): Meeting one of the following requirements.
    • Minor.
    • No capacity to earn a living.
    • Aged 25 or less, schooled, with monthly work income below level 1 of the Insured Salary Category Chart.
  3. Parents or grandparents: Aged 55 or more, with monthly work income not exceeding level 1 of the Insured Salary Category Chart.
  4. Grandchild(s): Those who are supported by the insured and meet one of the requirements for child(s) mentioned in Paragraph (2) above.
  5. Sibling(s): Supported by the insured and meet one of the following requirements.
    • Minor.
    • No capacity to earn a living.
Above 55 years old and the monthly working income does not exceed level 1 of the insured salary levels.
