57. There are many types of foreign labor, what documents shall be provided when enrolling in labor insurance?

When applying for labor insurance coverage for a foreign worker, in addition to the work permit documents prescribed below, the Insured Unit shall simultaneously submit the Labor Insurance Information Form for Foreign Insured Person to enable the foreign worker to claim relevant benefits. Such documents shall be mailed (hand-delivered) to the Bureau of Labor Insurance, Ministry of Labor for enrollment. (The Insured Unit shall submit the application for labor insurance enrollment on the employment date of the foreign worker. If there is any difficulty in submitting the supporting documents simultaneously, such documents may be provided at a later date upon receiving notice from the Bureau.)

Categories Proof Documents
Overseas Substitute Labor (Foreign Labor)
  1. Copy of the foreign labor hiring approval letter issued by the Ministry of Labor, Letter for Entry Visa or Letter for Substituting Labor.
  2. A copy of the “Employer Application for Hiring Foreign Workers”, or “Name List of Foreign Workers Employed,” or “Brief List of the Foreign Workers” showing clearly the personal information of the foreign national.
Note: If the copy of the residence permit has been annotated: “Foreign Labor - ______ (Name of the Business Unit)”, and the name of the business unit thereon is the same as the insured unit, the applicant may submit a copy of the residence permit as a substitute for the work permit or approval documents.
Taking over or continuous hiring of foreign labor
  1. Copy of the Approval letter for continuous hiring issued by The Ministry of Labor.
  2. A copy of the “Employer Application for Hiring Foreign Workers”, or “Name List of Foreign Workers Employed,” or “Brief List of the Foreign Workers” showing clearly the personal information of the foreign national.
Note: Where the foreign worker is transfered from another employer, the new employer shall enroll the worker in the insurance policy on the day he/she reports to work for continued employment. The employer, in the meantime, may use the following documents as alternatives to work permits:
  1. If the copy of the residence permit has been annotated: “Foreign Labor - ______ (Name of the Business Unit)”, and the name of the business unit thereon is the same as the insured unit, the applicant may submit a copy of the residence permit as a substitute for the work permit or approval documents.
  2.  A copy of the continuous hiring certificate issued by a Public Employment Service Institution, a copy of the continuous hiring notification certificate issued by the local competent authority, or a copy of the continuous hiring certificate agreed upon the three (two) parties. (In all cases, the employer shall apply for work permits separately.)
Foreign Professionals:
  1. Work in areas that require professional or technical skills.
  2. Managers of enterprises which have received government approval for establishment or investment.
  3. Foreign teachers in schools.
  4. Foreign language teachers in cram schools.
  5. Athletic coaches or athletes.
  6. Work in areas such as religion, the arts, and entertainment.
A copy of the work permit issued by the Ministry of Labor or the Ministry of Education, and a copy of the Employment Gold Card issued by the National Immigration Agency of the Ministry of the Interior.

Note:
  1. If the copy of the residence permit has been annotated: “Foreign Labor - ______ Business Unit”, and the name of the business unit thereon is the same as the insured unit, the applicant may submit a copy of the residence permit as a substitute for the work permit or approval documents.
  2. Individuals holding permanent alien resident certificates may directly file their work permit applications to the Ministry of Labor. It is not necessary to apply through the employers.
  3. No work permit is required if the applicant is a foreign consultant or researcher employed by government agencies at any level or their subordinating academic/research institutions. However, relevant employment documents shall be submitted.
  4. Effective beginning February 8, 2018, expatriate teachers working in schools shall apply for work permits from the Ministry of Education.
Foreign students, overseas Chinese 
students, or non-Chinese citizen students of Chinese origin
Copy of the Work Permit issued by the Ministry of Labor.
Foreign students in research programs or on internships Copy of the Work Permit issued by the Ministry of Labor or the competent authority in charge of the research or internship programs.
Foreign Technical Apprentice or Cooperative Education Program Student
  1. The insurance enrollment form for these individuals shall have either Technical Apprentice or a Cooperative Education Program Student remarks.
  2. (1)Foreign students (excluding Chinese students from  Mainland China): Do not require a work permit.
    (2)Foreign students (Chinese students from Mainland   China): Require a photocopy of a long-term residency permit or a work permit.
Foreign nationals holding approval for working holidays in Taiwan. A copy of the visa or residence permit annotated “WH (Working Holiday)” or “YM (Youth Mobility)”.
Foreign residents with dual citizenship that already have permanent residence Must indicate identification status on the application and attach related documentation:
  1. Copy of the passport issued by the Republic of China
  2. Copy of the data of permanent residence
Foreign residents with dual citizenship, but without permanent residence (including nationals without a registered permanent residence such as descendents of serviceman from Thailand and Myanmar stranded in Taiwan, and all Tibetan people stranded in Taiwan, etc.). Copy of The Work Permit issued by the Ministry of Labor or competent authority-in-charge
Single R.O.C. Nationality (including nationals without a registered permanent residence such as descendents of serviceman from Thailand and Myanmar stranded in Taiwan, and all Tibetan people stranded in Taiwan, etc.). It does not matter whether the national has obtained a residence permit or has permanent residence in the R.O.C., he or she does not need to enclose any approval documents, but needs to declare his or her identification status.
Foreigners (including people from Hong Kong and Macau) married to R.O.C .nationals and granted residency in Taiwan.
Note: Applicable to the Employment Insurance Act
A photocopy of the alien resident certificate annotated with "Holder of this certificate is not required to apply for a work permit.

Note: In case that the ARC does not carry the annotation "Holder of this certificate is not required to apply for a work permit", the ARC holder should provide a copy of the household registration record evidencing his/her marriage with a R.O.C citizen. If household registration has not yet been applied for, the ARC holder may provide relevant documents to prove the marriage relationship and the household registration record of the R.O.C. citizen.
Foreigners (including people from Hong Kong and Macau)married to R.O.C. nationals, but not yet granted residency in Taiwan. Copy of the Work Permit issued by the Ministry of Labor or competent authority-in-charge.
People from Mainland China who have received permission for spouse residency or long-term residency in Taiwan. 
Note: The Employment Insurance Act shall be applicable for spouses from Mainland China, but not applicable for other people from Mainland China.
Chinese spouses should attach a copy of the ARC with the annotation "Holder of this certificate is not required to apply for a work permit". People from the Mainland China area (excluding Chinese spouses) should attach a long-term residence certificate.

Note: Chinese persons who have registered permanent residence in Taiwan for less than 10 years may not work for public schools or state-owned enterprises and institutions. Chinese temporary workers hired by public enterprises, institutions, and schools with the above status according to the Temporary Employee Hiring Guidelines for Institutions and Schools Under the Executive Yuan are not limited by the 10 year limitation. The insurance enrollment form for these Chinese temporary workers shall have the Temporary Worker remarks. Chinese persons who have registered permanent residence in Taiwan for less than 20 years shall not take up clerical or teaching jobs in national defense agencies and institutions or be employed by the military.
Foreign spouses (including people from Hong Kong and Macau) and people from Mainland China who have received permission for spouse residency in Taiwan and are approved to stay after the divorce or the death of their spouses, who were R.O.C. nationals. 
Note: Applicable to the Employment Insurance Act
Chinese spouses should attach a copy of the ARC with the annotation "Holder of this certificate is not required to apply for a work permit". People from the Mainland China area (excluding Chinese spouses) should attach a long-term residence certificate.
  1. Divorce: documents providing evidence that the applicant has acquired the guardianship of his or her child or children under the age of 20 with registered permanent residence in Taiwan. 
  2. Decree of divorce due to domestic violence: 
    documents providing evidence that the applicant has received a decree of divorce granted by the court due to domestic violence, and documents proving that he or she has a child or children under the age of 20 with registered permanent residence in Taiwan. 
  3. Death of the Spouse with R.O.C. nationality: 
    Death certificate of the spouse. (If the attached documents without stating the two parties is a spouse, then it shall be attached a copy to proof the spousal relationship of both parties.) 
Chinese living in Hong Kong and Macau (other than those who are the spouses of R.O.C. nationals) Copy of The Work Permit issued by the Ministry of Labor or competent authority-in-charge.
Training foreign employees of foreign investment enterprises
  1. Copy of the approval letter for training the foreign employees in Taiwan issued by the competent authority-in-charge.
  2. Copy of the name list of the foreign employees that will be trained in Taiwan.
Foreign sailors or boat crew members Copy of the Work Permit issued by the Ministry of Transportation and Communication.
Foreign nationals employed as assistants or consultants of lawyers. Copy of The Work Permit issued by the Ministry of Labor.
Managers of enterprises established with foreign investment and technical specialists hired by companies in industrial science parks or Export Processing Zones of the MOEA Copy of the Work Permit issued by the Science Park Administration Bureau or the MOEA’s Export Processing Zone Administration Office.
Foreign domestic helpers
  1. A photocopy of the approval letter of hiring issued by the Ministry of Labor.
  2. Name list of foreign workers hired.
Note: When enrolling in insurance, the employer shall be designated the insured unit and the application shall be filed as a new enrollment.
