Farmer occupational injury insurance expands its coverage. Foreign spouses or individuals who have already received old-age benefits under related social insurance programs may apply to enroll on a voluntary basis.

Farmer occupational injury insurance (hereinafter referred to as “Farmer Occupational Insurance”) has expanded its coverage! Though not eligible to participate in the farmer health insurance, foreign spouses and individuals who are classified as category 3 insured persons under the National Health Insurance program and have already received the old-age benefits of related social insurance programs are now allowed to enroll in the Farmer occupational Insurance on a voluntary basis, subject to that they are actually engaged in agricultural activities.

According to “Farmer  Health Insurance Act” and the "Regulations Governing the Pilot Operation of the Farmer Occupational Injury Insurance", in the past, only individuals who had not received any old-age benefits under related social insurance were eligible to participate in Farmer Health Insurance or Farmer Occupational Insurance. In other words, farmers who had already received the old-age benefits from related social insurance were not qualified for Farmer Health Insurance hence not eligible for Farmer Occupational Insurance, despite the fact that they were actually engaged in agricultural activities. This has adversely affected their safety at work.

To ensure the occupational safety of the aforementioned farmers and provide economic compensation against occupational injuries, the Council of Agriculture, Executive Yuan has amended the "Regulations Governing the Pilot Operation of the Farmer Occupational Injury Insurance” and related regulations on August 5, 2019. The coverage of Farmer Occupational Insurance has been expanded to include those who have already received the old-age benefits from related social insurance programs (including the civil servant and teacher insurance pension payments, labor insurance pension payments, military personnel insurance discharge payments and national pension insurance old-age benefits), subject to that they have satisfied the requirements set forth in the “Regulations Governing the Recognition and Qualification Review for Participating in the National Health Insurance by Individuals Actually Engaged in Agricultural Activities” and are qualified as category 3 insured persons under the National Health Insurance program. Such individuals, in the meantime, shall be actually engaged in agricultural activities. The Farmer Occupational Insurance, in the meantime, has been extended to cover foreigners, stateless persons, R.O.C. nationals with no household registration, or spouses of R.O.C. nationals (including people of China or residents of Hong Kong and Macau). They are allowed to enroll in the Farmer Occupational Insurance based on their status as a category 3 insured person under the National Health Insurance program.

The BLI further reminded that, when applying for enrollment in Farmer Occupational Insurance using his/her status as a category 3 insured person under the National Health Insurance program, the applicant shall not at the same time participate in military personnel insurance, civil servant and teacher insurance, labor insurance (including voluntary enrollment in the occupational accident insurance thereunder) or employment insurance. If an individual has already enrolled in the Farmer Occupational Insurance using his/her status as a category 3 insured person under the National Health Insurance program, he/she shall withdraw from the Farmer Occupational Insurance before participating in other social insurance programs mentioned above.
