8. If, after receiving the labor insurance old-age benefits, an insured person is hired to be actually engaged in work again, voluntarily participates in the occupational accident insurance program and then dies, can his/her survivors claim the survivor benefits?
- In case the insured person's death is caused by an occupational injury or an occupational disease, the person who pays the funeral expenses can claim a funeral grant of five months’ pay. Besides, an eligible survivor can choose to claim a one-time survivor’s allowance of forty months’ pay or claim monthly payments of the survivor’s pension. (For those who claim the survivor’s pension, an extra ten months’ pay shall be given in a lump sum as compensation for the death caused by an occupational accident).
- In case the insured person’s death is caused by an ordinary injury or disease, his/her beneficiary shall not claim the survivor benefits.
