15. Suppose there is an insured person who is diagnosed as being permanently incapacitated for work and receives the disability benefits and whose labor insurance is directly terminated by the BLI according to the law. If this insured person dies within one year after the termination of force of said insurance because of the same injury or disease as occurred when he/she was still covered by said insurance or because of a disease resulting from aforesaid injury or disease, can the survivor benef

  1. If the insured person dies while receiving the monthly payments of labor insurance disability pension, his/her survivors can claim the survivor’s pension benefit or claim, all at once, the balance of the disability benefit after the deduction of the total amount of pension payments already received pursuant to Paragraph 1, Article 63-1 of the Labor Insurance Act.
     
  2. If the insured person dies after receiving a one-time disability benefit, his/her survivor(s) shall not claim the labor insurance survivor benefit anymore due to the termination of force of the insurance.
