Penalty

For the insured units that fail to handle labor occupational accident insurance-related procedures for its employees and the provisions of Paragraph 3 of Article 6 of the Labor Occupational Accident Insurance and Protection Act, those who have any of the following violations shall be punished according to the regulations:

  1. Failure to apply for or withdraw from insurance in accordance with regulations
    According to Article 96, Paragraph 1 of Article 99, and Article 100 of the Labor Occupational Accident Insurance and Protection Act, if the insured unit or employer fails to perform the insurance application and withdrawal procedures for their workers in accordance with Article 12 therein, a fine of NTD20,000 to NTD 100,000 shall be imposed, and correction shall be made within a time limit; those who fail to improve within the time limit shall be punished consecutively, and the violations of the insured unit will be announced as the reputational punishment.
  2. Failure to verify the declaration and adjustment of insured salary
    According to Paragraph 1 of Article 98, Paragraph 4 of Article 99, and Article 100 of the Labor Occupational Accident Insurance and Protection Act, the insured unit that violates the provisions of Paragraphs 1 to 3 of Article 17, where it overstates or understates the insured salary amount or fails to notify the monthly insured salary adjustment within the time limit will be fined NTD 20,000 to NTD 100,000, and the violations of the insured unit will be announced as the reputational punishment.
  3. Failure to bear the labor occupational accident insurance premium
    According to Paragraph 2 of Article 97, Paragraph 2 of Article 99, and Article 100 of the Labor Occupational Accident Insurance and Protection Act, if the insured unit that violates the provisions of Paragraphs 1of Article 19,  the labor occupational accident insurance premium is not borne by the insured unit in accordance with the regulations and the insured is bearing such payment, a fine of NTD 20,000 to NTD 100,000 shall be imposed, and correction shall be made within a time limit; those who fail to improve within the time limit shall be punished consecutively, and the violations of the insured unit will be announced as the reputational punishment.
  4. The list of employee  and attendance and salary information are not prepared
    According to Paragraph 1 of Article 97, Paragraph 2 of Article 99,and Article 100 of the Labor Occupational Accident Insurance and Protection Act, the insured unit fails to prepare relevant documents or keep them for a specified period, a fine of NTD20,000 to NTD 100,000 shall be imposed, and correction shall be made within a time limit; those who fail to improve within the time limit shall be punished consecutively, and the violations of the insured unit will be announced as the reputational punishment.
  5. Refusal to provide interview information
    According to Article 94, Paragraph 2 of Article 99,and Article 100 of the Labor Occupational Accident Insurance and Protection Act, the insured unit evades, obstructs or refuses the inspection by the insurer (the Bureau), a fine of NTD50,000 to NTD 300,000 shall be imposed, and correction shall be made within a time limit; those who fail to improve within the time limit shall be punished consecutively, and the violations of the insured unit will be announced as the reputational punishment.
  6. Long-term arrears of insurance premiums
    According to Paragraph 2 of Article 98, Paragraph 4 of Article 99, and Article 100 of the Labor Occupational Accident Insurance and Protection Act,  if the insured unit arrears insurance premiums, and after the insurer imposes a late payment fee of 20% of the due premiums in accordance with Paragraph 1 of Article 21, the due premiums have not been paid and the circumstances are severe, will be fined NTD 20,000 to NTD 100,000, and the violations of the insured unit will be announced as the reputational punishment.
  7. Reputational penalty
    For those insured units, employers, or NHI hospitals or clinics that violate this Act and have been fined, the competent authority shall announce the name, the name of the person in-charge, the date of announcement, the date of the punishment, the official letter number specifying the punishment, the violated provisions, the facts of the violation and the amount of punishment.
