12. The insured is assessed to be incapable of working for life, receives Permanent disability pension for complete or severe disability due to occupational injury or disease and whose insurance coverage has been terminated with the law by the BLI. If the insured person pass away due to the same occupational injury or disease within one year from the day following the end of coverage, can the surviving family members apply for Survivor Benefit from labor occupational accident insurance?

  1. If the insured passes away during the period of receiving the complete or severe permanent disability pension, the surviving family members may apply for the survivor pension in accordance with Article 50 of the Labor Occupational Accident Insurance and Protection Act. If the insured has already been covered by the insurance before the implementation of the labor insurance pension on January 1, 2009, he/she may also choose to claim the permanent disability payment in a lump-sum manner and deduct the difference of the total pension received.
  2. If the insured passes away after claiming the occupational accident permanent disability in a lump-sum manner, because the insurance effect has been terminated, the insured cannot claim the occupational accident death benefits again.
