2. Is there any difference in regulations on the actual performance fee rate of labor occupational accident insurance?

According to the calculation and adjustment method of the actual performance fee rate of labor occupational accident insurance revised and announced by the Ministry of Labor on March 9, 2022, the key points of the revision are:

  1. Expanded scope of application: The scope of application expands from the insured units employing more than 70 insureds to those with more than 50.
  2. Amended the calculation method of the addition and subtraction ratio of collection:
    (1) Before the amendment: For those below 70%, for every 10% of subtraction, the fee rate of industry-specific occupational accidents shall be subtracted by 5%. For those with more than 80%, for every 10% of addition, an additional 5% of the fee rate of industry-specific occupational accident rate shall be charged, and the surcharge rate shall not exceed 40%.
    (2) After the amendment: For those below 60%, for every 10% of subtraction, the fee rate of industry-specific occupational accidents shall be subtracted by 5%. For those with more than 80%, for every 10% of addition, an additional 5% of the fee rate of industry-specific occupational accident rate shall be charged, and the surcharge rate shall not exceed 30%.
    (3)Added the requirements for handling occupational safety and health measures: Occupational Safety and Health Administration, Ministry of Labor shall evaluate the occurrence of occupational accidents, and the occupational safety and health management performance of the insured unit in the most recent three years. Urge employers to abide by occupational safety and health laws, focus on occupational safety and health management, and avoid occupational accidents, so as to reduce the burden of labor occupational accident insurance premiums and achieve a win-win situation.
