12. Is a female insured person eligible for claiming disability benefits after having hysterectomy due to uterine fibroids at more than 45 years of age?

  1. The Attachment of the Labor Insurance Disability Benefit Payment Standards has been amended and promulgated by the Ministry of Labor on March 30, 2022 and taken effect on April 1, 2022. In this amendment, the age restriction on female insured persons claiming the reproductive organ disability benefit has been removed.
  2. According to the Attachment of the Labor Insurance Disability Benefit Payment Standards, an insured person suffering from organic disabilities should be assessed to determine his/her disability level on the day he/she is discharged from the hospital after the removal of the organ. For those whose disability diagnosis was confirmed on or after April 1, 2022 (the effective date of the amendment), the case should be handled in accordance with the amended Attachment. For those who have been diagnosed of the disability or have filed their claims for the disability benefit before the effective date, their applications should be reviewed in accordance with the prevailing Attachment before the amendment.
  3. If, during the effective period of the insurance, the insured person is removed of her both ovaries or uterus due to injury or illness, and has been diagnosed of disability on or after April 1, 2022, she is qualified for the benefits prescribed in the amended Attachment. She may, as a result, request the NHI designated hospital to issue a Disability Diagnosis Report, which should be mailed to the Bureau of Labor Insurance directly. The insured person should, through her insured unit, submit to the Bureau of Labor Insurance her application for the disability benefit, enclosing the Labor Insurance Permanent Disability Benefits Application Form and Payment Receipt, as well as the Proof of Direct Delivery of Labor Insurance Disability Statement, etc. However, if the insured person has undergone a hysterectomy before March 31, 2022 (inclusive) and has exceeded the age of 45 when diagnosed of the disability, she is not qualified for the disability benefit because she has not fulfilled the regulations on reproductive organ disability benefit prevailing before the amendment.
