16. Why does it need to append the “individualized professional assessment mechanism”? Does it have a premise of law?

The methods for rendering social insurance disability in industrialized countries are divided into two modes – the “physical injury level” and the “loss of working capability level”. Over the time, Taiwan’s labor insurance disability payout tends to adopt physical injury level rendering, but without taking into account the loss of working capability level to be criticized that the rendering lacks subjectivity.

Of stipulations provided by the labor insurance provisions amended and announced on January 1, 2009, the competent central government authorities shall instill an individualized professional assessment mechanism, as the basis of disability pension payout and shall also implement it within a five-year period following the provisions have been amended and announced (meaning by August 13, 2013).
